Welcome to the my blog and today’s topic: “Transparency between Lawyers in an ADR process: what a novel idea!”
In my 32 years of practice as a traditional family law lawyer, collaborative family lawyer and mediator, I have been struck by how challenging it is for lawyers, including myself!, to be transparent and open with their fellow lawyers in a case, even when engaging in an Alternative Resolution (ADR) process. It is an ongoing challenge for lawyers to “change hats” and be open and transparent when engaging in an ADR process, whether as a lawyer or as a mediator. There are often good and historical reasons for this. Having experienced just such a transformation recently in a collaborative family law case, I would like to share my thoughts with you.
